Terms of Service

By installing or using BackAlert, you agree to these terms of service.

1. Service Description

BackAlert is a Shopify app that enables merchants to offer back-in-stock email notifications, wishlists, low-stock alerts, and pre-order functionality to their customers. The service includes storefront widgets, automated email notifications, and a merchant dashboard with analytics.

2. Plans and Pricing

• Free — Up to 50 notifications per month
• Starter ($4.99/month) — Up to 500 notifications per month
• Pro ($14.99/month) — Unlimited notifications

All billing is handled through Shopify's Billing API. Unused notifications do not roll over. You can change or cancel your plan at any time.

3. Merchant Responsibilities

• You are responsible for complying with applicable laws regarding email communications (CAN-SPAM, GDPR) in your jurisdiction.
• BackAlert sends transactional notifications (not marketing emails) on your behalf. These are triggered by customer opt-in only.
• You must ensure your privacy policy informs customers about third-party notification services.
• You are responsible for the accuracy of your product inventory data.

4. Shopper Terms

• By subscribing to a notification, shoppers consent to receive a one-time email when the product is restocked.
• Shoppers can unsubscribe at any time via the link in the notification email.
• Wishlist data is stored locally in the browser and optionally synced to our servers when an email is provided.

5. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. When you uninstall the app, all associated data is deleted within 48 hours in compliance with Shopify's GDPR requirements.

6. Intellectual Property

BackAlert and its original content, features, and functionality are owned by Viriar s.r.o. The service is protected by copyright and other intellectual property laws.

7. Limitation of Liability

BackAlert is provided "as is" without warranties of any kind. We are not liable for missed notifications, email delivery failures, lost sales, or any indirect, incidental, or consequential damages arising from use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to the service at any time for violation of these terms or abuse. You may uninstall the app at any time through Shopify admin.

9. Changes

We may update these terms. Material changes will be communicated through the app dashboard. Continued use of the service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the Slovak Republic and the European Union.
